1.6 The Role of the City of Edinburgh Council

The City of Edinburgh of Council shall ensure that in the case of any breach of which it becomes aware and in respect of which it can enforce, it shall take such action as is necessary to ensure that such breach is remedied as soon as reasonable practicable to procure compliance with this Code.

In respect of any breach which is enforceable by any other statutory or other body, the City of Edinburgh Council shall alert the relevant body as soon as reasonable practicable after it becomes aware of such a breach so that that body can take such action in order to procure compliance with this Code.

The Director of City Development of the City of Edinburgh Council will nominate a suitably qualified person ('the Nominated City Officer') to be the liaison officer between the Council and the Contractor.

The name of the Nominated City Officer and his/her contact details will be published on the City of Edinburgh website and in appropriate printed publicity material produced by the Council. The Nominated City Officer will publish on the Council website and in other places as appropriate at least once per calendar month a Note of any breaches of this Code of Construction Practice occurring within the previous month, setting out;

  • the nature of the breach
  • the duration of the breach,
  • the action taken by the Contractor or the City of Edinburgh Council to mitigate the breach
  • steps taken to minimise the likelihood of a subsequent occurrence of the breach
  • any contractual penalty imposed upon the Contractor as a result of the breach.
